Maelivia
Maelivia Terms of Use

These terms are an agreement between you and Ömer Faruk Şimşek, Ankara, Türkiye ("we", "us") about your use of the Maelivia app and its services ("Maelivia"). By using Maelivia you accept these terms. If you do not accept them, do not use the app.
1. Relationship to Apple's terms
You get the app from the App Store, so Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. If these terms and Apple's standard EULA conflict, these terms apply to the extent the law and Apple allow. Apple is not a party to these terms and is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
2. Who can use Maelivia
You must be at least 13 years old (16 in the European Economic Area), or the age of digital consent in your country, to use Maelivia. If you are under 18, use it with a parent or guardian's permission and supervision, especially when cooking.
3. What Maelivia is
Maelivia helps you follow recipes while you cook. It tracks steps and timers, answers questions with an AI assistant, can listen and speak, and can turn recipe text you paste into a structured recipe. You can use the core features without an account. An optional account lets you keep your data across devices.
4. Cooking, food safety and allergens
Cooking involves heat, sharp tools, gas and food that can make people ill. You are responsible for your own safety in the kitchen. In particular:
- Check that food is cooked through and stored safely. Follow food safety guidance and the instructions on product packaging.
- Allergen warnings are based on the allergens you select and on our ingredient list. They can be incomplete or wrong. An ingredient the app does not recognise is shown as unknown, not as safe. Always read product labels. Do not rely on Maelivia to manage a food allergy or any medical condition.
- Recipes, including the ones in our libraries, may contain mistakes. Use your judgement.
- Never leave cooking unattended because the app has set a timer. Timers and notifications can be delayed or missed, for example if your phone is silent, out of battery or offline.
5. Emergencies
If you mention a fire, burn, cut, choking, allergic reaction or gas smell, Maelivia may show short safety guidance and your local emergency number. This guidance is not medical advice, is general, may not fit your situation, and does not replace emergency services or a medical professional. In an emergency, call your local emergency number (for example 112 in Türkiye and the EU, 911 in the US) immediately. Maelivia does not call emergency services for you.
6. AI-generated content
The assistant's replies, imported recipes and voice output are produced by AI models from third parties. AI output can be inaccurate, incomplete or unsuitable. It is not professional advice (medical, nutritional, dietary or otherwise). Check important information yourself. You decide what to do with the output. Speech recognition can mishear you, so the assistant may act on something you did not mean; check the screen when it matters.
7. Your content
"Your content" means recipe text you import, what you say or type to the assistant, and your settings. You keep all rights to your content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, process and transmit your content only to provide, secure and improve Cook Copilot, as described in our Privacy Policy (https://maelivia.com/privacy). Imported recipes are private to you; we do not publish them to other users without your permission.
You confirm that you have the right to use the recipe text you import, and that your content does not break the law or anyone else's rights.
8. Acceptable use
Do not:
- use Maelivia for anything illegal or harmful, or to create content that is;
- try to get around usage limits, subscriptions or security, or access other users' data;
- reverse engineer, scrape or overload the service, or use it to build a competing service, except where the law allows this despite this restriction;
- use the assistant or recipe import for anything other than cooking and food, or in a way that creates excessive cost (for example automated or bulk requests).
We may suspend or limit access if you break these terms or to protect the service or other users.
9. Accounts
Keep your password secret and your email address current. You are responsible for activity under your account. You can delete your account at any time in the app (Profile > Account > Delete account). This deletes your data as described in the Privacy Policy. It does not cancel an App Store subscription.
10. Maelivia Pro subscriptions
- Free tier: built-in recipes and cooking with timers, plus one hands-free voice session. We may change the free limits; we will show the current limits in the app.
- Pro: recipe import and further hands-free voice sessions, as described in the app at the time of purchase. It is offered as an auto-renewable subscription, weekly or yearly, with an allowance of hands-free voice sessions per week or per month that the app shows. Prices are shown in the app before you buy and may vary by country.
- Payment and renewal: payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically for the same period and price unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
- Free trials and offers: if a free trial or introductory offer is shown, any unused part of a free trial ends when you buy a subscription.
- Cancelling: manage or cancel in your Apple Account settings (Settings > your name > Subscriptions). Cancelling stops the next renewal; you keep Pro until the end of the period you have paid for.
- Refunds: Apple handles payments and refunds under its own policies (reportaproblem.apple.com). We cannot issue refunds for App Store purchases. This does not limit any rights you have under consumer law.
- Restore purchases: use "Restore purchases" in the app to restore Pro on a new device with the same Apple Account.
- Fair use: Pro features rely on paid AI and voice services. To keep the service available, we may apply reasonable limits that we show in the app.
- Price changes: Apple notifies you of price increases and, where required, asks for your consent.
11. Availability and changes
We work to keep Maelivia running but do not promise it will always be available, error-free or work with every recipe. AI and voice features need an internet connection and depend on third-party providers. We may change, add or remove features. If we stop offering Maelivia, we will tell you in advance where we can.
12. Our rights
The app, its design, the built-in recipe libraries and our trademarks belong to us or our licensors. These terms give you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, as allowed by Apple's terms. Nothing else is licensed to you.
13. Disclaimers
To the extent the law allows, Maelivia is provided "as is" and "as available", without warranties of any kind, including warranties of accuracy, fitness for a particular purpose and non-infringement. Nothing in these terms limits rights you have as a consumer that cannot be limited by law.
14. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill. Our total liability for all claims about Cook Copilot is limited to the amount you paid us for Maelivia in the 12 months before the claim, or USD 50 if you paid nothing. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for anything else that cannot be excluded or limited by law.
15. Ending these terms
You can stop using Maelivia at any time and delete your account in the app. We may end these terms or suspend your access if you seriously or repeatedly break them, with notice where reasonable. Sections 4 to 7 and 12 to 16 continue to apply after the terms end.
16. Law and disputes
These terms are governed by the laws of the Republic of Türkiye, and the courts of Ankara have jurisdiction, without affecting any mandatory consumer protection rights in your country of residence. If you are a consumer in Türkiye, you may also apply to the consumer arbitration committees (tüketici hakem heyetleri) and consumer courts under Law No. 6502. If you are a consumer in the EU, you may also bring proceedings in your country of residence.
17. Changes to these terms
We may update these terms. We will change the effective date and, for significant changes, tell you in the app before they apply. If you keep using Maelivia after the changes apply, the new terms apply. If you do not agree, stop using Maelivia and delete your account.
